These Terms & Conditions (“Terms”) govern your access to and use of the Vebarua mobile applications and website (collectively, the “Platform”).

By creating an account, accessing, or using Vebarua, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About Vebarua

Vebarua is a digital platform that connects clients seeking household or service based work with independent workers offering such services.

Vebarua does not employ workers and does not provide services directly. We facilitate connections only.

2. Eligibility

To use Vebarua, you must:

  • Be at least 18 years old
  • Provide accurate and truthful information
  • Have legal capacity to enter into contracts under Kenyan law

Workers must provide valid identification for verification.

3. Account Registration

You agree to:

  • Create only one account
  • Keep your login credentials secure
  • Update your information when it changes
  • Accept responsibility for all activity under your account

Vebarua may suspend or terminate accounts that provide false or misleading information.

4. Client Responsibilities

As a client, you agree to:

  • Provide accurate job details
  • Treat workers with respect and dignity
  • Pay agreed fees promptly
  • Avoid illegal, unsafe, or exploitative requests
  • Not solicit workers outside the platform in violation of Vebarua policies

5. Worker Responsibilities

As a worker, you agree to:

  • Provide truthful personal and skill information
  • Perform jobs professionally and safely
  • Respect clients’ property and privacy
  • Follow agreed schedules and instructions
  • Comply with Kenyan laws and regulations

Workers are independent contractors, not Vebarua employees.

6. Payments & Fees

6.1 Payments

Payments are processed through approved payment providers (e.g. M-Pesa). Vebarua may charge booking or service fees and deduct commissions where applicable. Pricing is displayed clearly before confirmation.

Vebarua does not store full payment credentials.

6.2 Refunds

Refund eligibility depends on job status, cancellation timing, and applicable policies displayed in the app. Vebarua reserves the right to make final refund decisions.

7. Cancellations

Both clients and workers may cancel bookings subject to Vebarua’s cancellation rules. Repeated cancellations, no-shows, or abuse may result in penalties, reduced visibility, or account suspension or termination.

8. Ratings & Reviews

Users may leave ratings and reviews based on real experiences. Reviews must be honest and respectful. Vebarua may remove abusive, false, or misleading content. Ratings do not guarantee future outcomes.

9. Platform Use Restrictions

You must not:

  • Use Vebarua for illegal purposes
  • Harass, abuse, or discriminate
  • Circumvent payments or platform fees
  • Scrape, copy, or reverse-engineer the app
  • Introduce malware or interfere with platform operations

10. Suspension & Termination

Vebarua may suspend or terminate your account if you violate these Terms, engage in fraud or abuse, harm other users, or breach applicable laws. Termination may occur without prior notice where necessary.

11. Data Protection & Privacy

Your personal data is handled according to our Privacy Policy, which forms part of these Terms.

12. Data Deletion

You may request account and data deletion as outlined in our Privacy Policy. Some data (such as payment records) may be retained where legally required.

13. Disclaimers

Vebarua provides the Platform “as is” and “as available.” We do not guarantee job availability, worker performance, client satisfaction, or uninterrupted operation. Users engage with each other at their own risk.

14. Limitation of Liability

To the maximum extent permitted by law, Vebarua shall not be liable for personal injury, property damage, loss of income, disputes between users, or indirect or consequential damages.

Any total liability shall not exceed the fees paid to Vebarua in the preceding three (3) months.

15. Indemnity

You agree to indemnify and hold Vebarua harmless from any claims, damages, or losses arising from your use of the Platform, violation of these Terms, or interaction with other users.

16. Intellectual Property

All content, trademarks, logos, and software on Vebarua belong to Vebarua or its licensors. You may not use Vebarua intellectual property without written permission.

17. Changes to These Terms

Vebarua may update these Terms from time to time. Continued use of the Platform after changes means you accept the updated Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Disputes shall first be resolved amicably. If unresolved, disputes shall be submitted to Kenyan courts with appropriate jurisdiction.
